Not Been Paid? — Step by Step

Escalation Path
Chase politely — Phone call + follow-up email. Keep a written record of every conversation
Formal payment reminder — In writing. Cite your contract terms, the amount, and when it was due
Payment notice — If under the Construction Act — serve a payment application / notice with the sum due and basis of calculation
"Smash and grab" adjudication — If no valid payment notice or pay less notice has been received — you can adjudicate for the full notified sum
7-day suspension notice — If past the final date for payment and still not paid — serve written notice of intention to suspend
Letter before action — Follow the pre-action protocol. Give 14 days to respond. State you will commence proceedings
Court or adjudication — Small claims (under £10k), County Court (£10k–£100k), or Construction Act adjudication (any value, 28-day decision)
