Under Section 34 of the Environmental Protection Act 1990, anyone who produces, carries, or receives controlled waste must complete a Waste Transfer Note. Digital waste tracking becomes mandatory from October 2026.

What the law actually says
- •The Environmental Protection Act 1990 (Duty of Care) makes you legally responsible for your waste from cradle to grave, even after a licensed carrier takes it.
- •A compliant WTN must include EWC codes, waste description, quantity, parties' details and signed declarations. Both parties must keep it for at least 2 years.
- •Unlimited fines on conviction for fly-tipping or breach of duty of care. Vehicle seizure is now routine.
