What the law actually says
- •A contemporaneous site diary is the strongest evidence in a construction dispute. Adjudicators, judges and insurers all weight it heavily.
- •Under JCT, NEC and most bespoke contracts, claims for delay, disruption or variation must be supported by records. No records, no claim.
- •Diaries should be made on the day, not retrofitted. Backdated entries are routinely thrown out.
